Usage

To use Giveaway-Bot | System, you must:

• Be legally permitted to use Discord
• Be over the age of 13

By inviting or using the bot, you agree to the use of channel IDs, message IDs, and server IDs as outlined in the Privacy Policy.

Dashboard Usage

By accessing the Giveaway-Bot Dashboard, you agree to:

• Provide accurate information during authentication
• Keep your Discord account credentials secure
• Only manage servers where you have proper authorization
• Not share your dashboard session with others
• Log out from shared or public computers

Admin Dashboard & Owner-Only Access

The admin dashboard (/admin-dashboard) is restricted exclusively to the registered bot owner account. Access by any other Discord account is automatically blocked and will result in an immediate redirect. Attempting to access admin features without authorization is a violation of these Terms and may result in a permanent dashboard ban.

The admin dashboard provides internal controls including:

• Viewing and managing bot health metrics and server logs (PM2 stdout / stderr)
• Enabling or disabling Dev Mode and Debug Mode for the bot process
• Initiating controlled dashboard restarts
• Reviewing admin activity logs (restart history with timestamps and status)
• Managing user dashboard bans (issuing and revoking bans by Discord User ID)

These controls affect the live operation of the bot and the dashboard infrastructure. Unauthorized access attempts are logged.

Dashboard Bans & Access Restrictions

The bot owner reserves the right to ban any Discord account from accessing the dashboard at any time, without prior notice, for reasons including but not limited to:

• Violation of these Terms of Service
• Abuse of dashboard features or API endpoints
• Unauthorized access attempts
• Fraudulent or harmful activity via the bot or dashboard

When a ban is issued, the affected user's Discord ID, username, ban reason, and ban date are stored in our database. This record is deleted as soon as the ban is lifted. A banned user who attempts to log in will be denied access and redirected accordingly.

Account Security

Your Responsibility. You are responsible for maintaining the security of your Discord account. If you believe your account has been compromised, immediately:

• Change your Discord password
• Revoke dashboard access in Discord's Authorized Apps settings
• Contact us at [email protected]

Giveaway Management

When creating and managing giveaways through the dashboard, you agree to:

• Ensure prizes are legitimate and deliverable
• Not create fake or misleading giveaways
• Honor all announced winners
• Not manipulate winner selection
• Comply with Discord's Community Guidelines
• Not use giveaways for phishing, scams, or illegal activities

Violation of these terms may result in immediate suspension of dashboard access and bot removal.

User-Generated Content & Platform Liability

Important: Your Sole Responsibility. You are solely responsible for all giveaway content you create, including prizes, descriptions, images, and requirements. Giveaway-Bot | System acts only as a technical platform and does not monitor, verify, or endorse any giveaway content.

By creating a giveaway, you acknowledge and agree that:

• You are the sole creator and responsible party for all giveaway content
• We do not pre-screen, monitor, or control giveaway content
• We are not liable for any claims arising from your giveaway content
• You will comply with all applicable laws in your jurisdiction
• You will not hold Giveaway-Bot | System responsible for disputes with giveaway participants

Strictly Prohibited Giveaway Content

You must NOT create giveaways containing, promoting, or related to:

• Illegal goods or services: Drugs, weapons, counterfeit items, stolen goods
• Adult content: Pornography, sexual services, adult-only products
• Hate speech or extremism: Nazi symbols, terrorist propaganda, discriminatory content
• Fraudulent schemes: Pyramid schemes, fake cryptocurrencies, phishing attempts
• Harmful products: Self-harm promotion, dangerous challenges, unregulated pharmaceuticals
• Intellectual property violations: Pirated software, cracked accounts, stolen game keys
• Personal data: Passwords, credit card numbers, private documents
• Misleading or deceptive content: False promises, fake sponsorships, impersonation

Violation of these prohibitions will result in immediate giveaway deletion, account suspension, bot removal from your servers, and potential legal action.

Server Management Permissions

The dashboard allows you to manage bot settings for servers where you have administrative permissions. You must:

• Have proper authorization from server owners
• Not change settings on behalf of others without permission
• Not use bot features to bypass server moderation
• Respect server rules and Discord's Terms of Service

Rules

You must not:

• Use the bot to harass others
• Spam bot commands
• Manipulate server count or abuse hosting
• Exploit, harm, or reverse-engineer the bot
• Advertise the bot as your own

Rate Limits & Fair Use

To ensure service quality for all users, we implement the following limits:

• Maximum 50 active giveaways per server
• Maximum 10 giveaway creations per hour per server
• Dashboard API rate limit: 100 requests per minute

Excessive usage or attempts to circumvent these limits may result in temporary or permanent service suspension.

Service Availability

We strive to provide 99.9% uptime for both the bot and dashboard. However, we do not guarantee uninterrupted service and are not liable for:

• Scheduled maintenance downtime (announced in advance)
• Discord API outages or rate limits
• Force majeure events (server failures, DDoS attacks, etc.)
• Data loss due to unforeseen circumstances
• Temporary unavailability caused by controlled restarts initiated via the admin dashboard

We maintain regular backups but recommend keeping your own records of important giveaway data.

Maintenance Modes (Dev & Debug Mode)

The bot and dashboard may occasionally enter Dev Mode or Debug Mode for maintenance, testing, or diagnostics purposes. These modes are controlled exclusively via the admin dashboard and may affect the bot's availability or behavior:

• Dev Mode: When enabled, the bot may restrict commands to a test environment or behave differently from normal operation. This is a temporary state used during development or hotfix deployment.
• Debug Mode: When enabled, verbose logging is active on the server. This does not affect end-user functionality but may slightly impact performance.

We will endeavor to announce significant maintenance windows in our Discord support server in advance. We are not liable for service disruptions caused by these operational modes.

No Monitoring Obligation (§ 10 TMG)

Giveaway-Bot | System operates as a hosting provider (Hostprovider) under German law. In accordance with § 10 TMG (Telemediengesetz), we:

• Are not obligated to proactively monitor user-generated giveaway content
• Are not responsible for content created by users unless we have actual knowledge of illegal activity
• Will remove or block access to illegal content promptly upon obtaining knowledge
• Reserve the right, but have no obligation, to review giveaway content at our discretion
• Act in accordance with the “Notice and Takedown” principle under German and European law

Reporting Illegal Content: If you become aware of illegal giveaway content, report it immediately to [email protected] with the subject line “Legal Violation Report” and provide:

• The giveaway message link or ID
• Server ID and channel ID
• Detailed description of the violation
• Screenshots or evidence (if applicable)

Response Time: We will investigate all reports within 48 hours (business days) and take appropriate action, including content removal, user suspension, and cooperation with law enforcement if warranted.

Sponsorship & Partner Promotions

Giveaway-Bot | System maintains a sponsorship partnership with AVORO (a spirit of dataforest GmbH). In exchange for promoting AVORO's hosting services on our website, including a dedicated partner page, we receive server and/or domain hosting free of charge or at a reduced cost.

This constitutes commercial communication under German law (§ 5a UWG). Any page, banner, or link referencing AVORO on this website is disclosed as sponsored content and represents advertising for our partner, not an independent recommendation.

We do not control, guarantee, or take responsibility for AVORO's products, pricing, service quality, contract terms, or order fulfillment. Any purchase or contract you enter into with AVORO is solely between you and AVORO. Giveaway-Bot | System is not a party to that agreement and accepts no liability arising from it.

Indemnification & Hold Harmless

You agree to defend, indemnify, and hold harmless Giveaway-Bot | System, its operators, developers, affiliates, hosting providers, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising from or related to:

• Your giveaway content, prizes, descriptions, or fulfillment obligations
• Your violation of these Terms of Service or any applicable laws
• Your violation of any third-party rights, including intellectual property, privacy, publicity, or contractual rights
• Claims by giveaway participants or winners regarding prizes, eligibility, or selection process
• Any disputes between you and giveaway participants or third parties
• Fraudulent, deceptive, or illegal activities conducted through your giveaways
• Your use or misuse of the bot, dashboard, or any related services

This indemnification obligation survives termination of these Terms of Service and your use of the service.

Validity

These terms apply globally to any use of Giveaway-Bot | System since March 16th, 2022. We reserve the right to update them as needed.

Discord Terms

Discord's Terms of Service and Community Guidelines apply to all use of this bot. We are not affiliated with, endorsed by, or sponsored by Discord, Inc.

Intellectual Property & Code Protection

All content, design elements, and source code of this website and dashboard are protected by copyright law and owned by Giveaway-Bot | System.

Prohibited Actions

• Copying, redistributing, or selling any portion of this website's source code
• Reverse-engineering or decompiling the bot's code or algorithms
• Using our HTML, CSS, JavaScript, or design elements in your own projects
• Creating derivative works based on our codebase without written permission
• Removing or altering copyright notices or attribution

Violations of these intellectual property rights may result in legal action under German and international copyright law.

Termination of Service

We reserve the right to suspend or terminate your access to the dashboard and bot without prior notice if you:

• Violate these Terms of Service
• Violate Discord's Terms of Service or Community Guidelines
• Engage in abusive, fraudulent, or illegal activities
• Attempt to exploit security vulnerabilities
• Repeatedly create spam or nuisance reports
• Create prohibited giveaway content as outlined in these terms
• Attempt to access the admin dashboard without authorization

Upon termination, your dashboard access will be revoked, but server data may be retained for up to 90 days for security and legal compliance purposes.

Changes to Terms

We may update these Terms of Service at any time. Significant changes will be announced via:

• Dashboard notification banner
• Discord support server announcement
• Email notification (if you provided an email address)

Continued use of the service after changes constitutes acceptance of the updated terms. If you do not agree to the updated terms, you must immediately cease using the service.

Consent & Acceptance

By inviting Giveaway-Bot | System to your Discord server, using the dashboard, or interacting with the bot in any way, you explicitly agree to:

• These Terms of Service in their entirety
• Discord's Terms of Service and Community Guidelines
• Full responsibility for all giveaway content you create
• The prohibition of illegal, harmful, or objectionable giveaway content
• Indemnification of Giveaway-Bot | System from any and all third-party claims
• The collection and processing of data as described in our Privacy Policy

Legal Effect: This agreement is legally binding. If you do not agree to these terms, you must immediately:

• Cease using the bot and dashboard
• Remove the bot from all Discord servers under your control
• Delete any stored data through the dashboard settings

By continuing to use the service after reading these terms, you confirm that you have read, understood, and agree to be bound by them.

GDPR / DSGVO Compliance

If you are a resident of the European Economic Area (EEA), you have the following rights under the General Data Protection Regulation (GDPR):

• Right to Access: Request a copy of all personal data we hold about you
• Right to Rectification: Correct inaccurate or incomplete data
• Right to Erasure: Request deletion of your personal data
• Right to Restriction: Limit how we process your data
• Right to Portability: Receive your data in a machine-readable format
• Right to Object: Object to data processing for certain purposes
